Rezoning & Map Amendments

When a project does not fit the current zoning of a property, a zoning map amendment is usually the path forward. We evaluate whether a change is realistic, prepare the application and justification under the Comprehensive Plan, coordinate with planning staff and neighbors, and present the case at public hearings through the final vote of the legislative body.

Variances & Conditional Use Permits

Many projects need relief from a specific dimensional standard — a setback, height limit, parking requirement or sign regulation — or approval of a use that is allowed only on conditions. We prepare variance, waiver and conditional use permit applications and represent owners before the Board of Zoning Adjustment.

Development Plans & Subdivisions

We help owners, builders and developers move plans through review: detailed and revised development plans, subdivision and minor plats, changes to binding elements, and the conditions that come with approval. We work alongside engineers, surveyors and architects so that the legal and technical sides of a project stay aligned.

Planning Commission & BOZA Hearings

Public hearings decide most land use cases. We prepare testimony and exhibits, respond to staff reports and opposition, and represent clients before the Planning Commission, the Board of Zoning Adjustment, their committees and the Metro Council, as well as at the neighborhood meetings that often come first.

Land Use Due Diligence

Before a purchase, lease or loan closes, it pays to know what a property can legally be used for. We review zoning classification, existing approvals and binding elements, nonconforming rights and pending changes, and explain the risks and the approvals a planned use would require.

Zoning Appeals & Litigation

When a land use decision goes the wrong way, or a property owner faces a zoning enforcement action, we evaluate the options, including administrative appeals and judicial review in circuit court, and represent clients through the process.

Not sure which of these applies to your property? Call (502) 387-4624 or send a short description — sorting that out is usually the first step.
